In applying for a private security service license, the applicant must (a) be a company registered in accordance with the Myanmar Companies Act. (b) If it is a foreign company, it must have been registered in accordance with the Myanmar Companies Act. (c) It must not be a company with a reputation that undermines the security and rule of law of the country. (d) It is stipulated that during the operation of the private security service business, it must deposit at least one hundred thousand kyats as a business guarantee with the Myanmar Economic Bank, or in the case of a foreign company, a foreign currency equivalent to one hundred thousand kyats as a fixed deposit.
The law also stipulates the information required by those who want to apply for a license.
In addition, the licensee must operate the private security service business in accordance with the terms of the license and must operate in accordance with the rules, regulations, rules, notices, orders, instructions and procedures issued under this law. The law states that when security cooperation with state security organizations is required, it must be carried out systematically in accordance with the plans of the relevant supervisory committee and state security organizations.
In the case of appointing private security personnel, the following requirements must be met: Myanmar citizens must be at least 18 years of age, in good health and able to perform security duties, holding a labor registration card issued by a relevant government department or government organization, having obtained a certificate and self-declaration of innocence within 30 days, not having any qualifications specified by the Central Committee from time to time, and those selected for appointment must attend a private security service training course opened with the approval of the Central Committee.
In addition, in the case of appointing private security personnel, foreigners must (1) meet the rules and regulations set by the Ministry of Labor; (2) have a certificate of innocence from the relevant country; (3) not be a member of the armed forces of a foreign country; The law stipulates that if the licensee is a foreign company, at least 75 percent of the private security personnel must be Myanmar nationals.
Anyone who wants to hire more than 10 security personnel for their own business or subsidiary, not for private security services, must apply for a permit to the relevant supervisory committee, providing information. The permit is valid for three years from the date of issuance.
