The law contains the following provisions: Chapter (1) defines the name and definition, Chapter (2) the purpose, Chapter (3) the formation of the central committee and its duties and powers, Chapter (4) the formation of the supervisory committee and its duties and powers, Chapter (5) the application for a license, Chapter (6) the duties and rights of the licensee, Chapter (7) the application for a permit and the duties of the permit holder, Chapter (8) the duties and powers of the private security personnel, Chapter (9) the resolution of disputes, Chapter (10) administrative action, Chapter (11) prohibitions, Chapter (12) crimes and penalties, Chapter (13) general, etc.
The purposes of the law include (a) to ensure that private security services contribute to the security of the state, the rule of law and public peace; (b) to ensure that private security services can cooperate systematically with the security organizations of the state; (c) To develop human resources related to private security services and to develop international-level private security services; (d) To supervise the private security services systematically to prevent misuse; (e) To cooperate with international organizations and regional organizations in relation to private security services.
The Union Government shall form the Central Committee for Supervision of Private Security Services with the Union Minister for Home Affairs as the Chairman, the Police Chief of the Ministry of Home Affairs as the Vice Chairman, the Deputy Police Chief of the Ministry of Home Affairs as the Secretary, and the Police Chief of the Ministry of Home Affairs as the Joint Secretary, and shall be composed of 12 Directors-General from 12 ministries as members.
The duties and powers of the Central Committee shall include: formulating policies and supervising private security services with the consent of the Union Government; To guide, supervise and make decisions on the activities of the Supervisory Committee; To submit to the National Defense and Security Council for its opinion if a licensee applies for permission to carry weapons as required in the operation of private security services; To determine the license fee, license renewal fee, service fee, license terms and conditions and permit terms; To determine the terms and conditions for license suspension, license cancellation or revocation; To examine and approve or reject the submission of the Supervisory Committee’s opinion on the application for a license or license extension; To examine and approve or reject the submission of the Supervisory Committee’s opinion on the application for a license or license extension; To cooperate with international organizations and regional organizations in relation to private security services; These include encouraging the emergence of international-level private security service training courses, allowing the verification of the private security personnel of the licensee, approving the uniform, badge and rank insignia of the private security personnel, determining the fees to be paid for private security services from time to time, and carrying out the duties related to private security services assigned by the Union Government from time to time.
In addition, the Minister of Security and Border Affairs is authorized to form a regional or state supervision committee, which will be chaired by the Minister of Security and Border Affairs, and the Chairman of the Nay Pyi Taw Council will also take the chair of the Union Territory Supervision Committee.
